finance company has taken my car away because my brother was caught driving it with no insurance,what can i do?
2 days ago, my brother stupidly took my high performance Mercedes vehicle without my permission. Later that i discovered he was arrested for driving with no insurance. I bought the car on finance, bought it for ?34k and put a ?10k deposit down, so far i have paid off 1 years worth coming to about ?6k. The finance company say that i have breached the contract as no one else is allowed to drive the vehicle at any moment with no insurance and that they have the right to either sell it, (as they own it) or they are asking me to pay the whole finance off (including interest and extra fees on top coming to over 40k. i just dont have that sort of money. I have never missed a payment and due to my younger brothers stupidity i have to pay. He is getting 3 points on his license and has a ?200 fine but i dont see why i have to suffer in this. Is there anyone out there at all that can advise me who to see or whom to speak to???
Sounds like you did not have insurance on it yourself.
All insurance companies cover uninsured motorists in the US.

If your brother took it without asking report it as stolen or twoc…taken without consent…then your brother will get hit with a theft charge but at least your finance company cannot hold you to breach of contract because it was taken without your permission or knowing.
Thought it means dobbing your brother in..but it sounds like he deserves it for the trouble he caused you and at least he will owe you that.

Presumably the police came to you as the owner of the vehicle and you told them it had not been stolen? This then tells the finance company that you gave him permission to drive it – so unfortunately I do not see any way out of your predicament.
However it is a credit/financial agreement so carefully check the details you have first, it is about the money not the car- so unless it states in the agreement that they can reclaim the vehicle, which normally they only get to do if you default on payments I do not see how they can do this.
You must go through the agreement first though – if it is too full of legalese to understand, try CAB,
or you could join which? legal pronto – and get some decent advice – they may be able to get you out of it if given the details of your finance agreement. Unless you have legal assistance with your own insurance/breakdown, who also may be able to help.

When it comes time for renewal car insurance is a no brainer way to save a lot of money. You can get a quick estimate at websites they usually give you competing quotes.

what you can do all depends on what you and / or your brother told the police and the finance company.
Basically if no-one else is allowed to drive the car and you or your brother told the finance people that he was driving the car with your permission, then you are stuck and there is little you can do.
If, however, the police were informed that the car was stolen, then it is not your fault that someone else was driving the car and there is nothing the finance company can do.
It all depends whether you want to report your brother for stealing your car.
